On combating new types of economic crimes in Russia and the United States

Priorities of Improving Criminal Law Support for Combating Economic Crimes in Russia

First: improve the law-making mechanism as related to preparing and adopting decisions to criminalize/decriminalize (penalize/depenalize) economic behavior injurious to the public.

Second: improve certain institutions in the General Part of the Russian criminal law to make them better suited to ensuring normal functioning of the economy, including the creation of additional guarantees of effective efforts against corruption and organized crime.

Third: develop the institution of compromise as a means of enhancing the effectiveness of combating certain crimes against property and crimes in the field of economic activities.

Fourth: optimize the structure of the Special Part of the Russian Criminal Code to enhance the effectiveness of combating crimes in the economic field.

Fifth: fill the gaps in the criminal law protection of economic relationships resulting from shortcomings in law-making activities and the emergence of new types and forms of crimes in the economic field (crimes against property and crimes in economic activities).

Sixth: lower the level of uncertainty of descriptions and sanctions pertaining to norms of liability for economic crimes.

Seventh: bring the severity of punishment for certain crimes against property and crimes in the field of economic activities into conformity with the social danger thereof.

Eighth: improve the norms of liability for certain types of organized criminal activities posing the greatest threats to the normal functioning and development of the economy.
